1. Introduction

Welcome to JewelsPe Solutions (“JewelsPe”, “we”, “our”, or “us”).
By accessing or using our website, mobile application, or any services offered by us (collectively, “Platform”), you (“User”, “Subscriber”, “Investor”, or “Jeweller”) agree to be bound by the following Terms & Conditions.

These Terms govern your use of our Platform, investment services, jewellery listings, wallet system, and all associated functionalities.
If you do not agree to these Terms, you must refrain from using our services.

JewelsPe Solutions provides a digital platform that connects verified jewellers and subscribers, allowing users to invest in commodities like gold, silver, and diamonds and redeem their value by purchasing jewellery through the listed jewellers.

2. Definitions

• “Subscriber” / “Investor” refers to an individual user who invests in digital gold, silver, or other commodities via JewelsPe.

• “Jeweller” / “Shopkeeper” refers to a registered jewellery seller listing products and offers on JewelsPe.

• “Admin” / “Company” refers to JewelsPe Solutions, the platform owner and operator.

• “Wallet” refers to the digital ledger maintained by JewelsPe for tracking balances, investments, and purchase redemptions.

• “Platform” refers collectively to the JewelsPe website, mobile app, and all related services.

• “Commodities” include gold, silver, diamond, and other precious metals supported by the platform.

• “User Account” refers to a registered profile on JewelsPe for either a Subscriber or Jeweller.

3. Acceptance of Terms

By registering on JewelsPe, browsing, or engaging in any transaction, you acknowledge that:

• You are at least 18 years old and legally competent to enter into a binding agreement.

• You have read, understood, and agree to abide by these Terms.

• JewelsPe reserves the right to modify these Terms anytime, with updates published on the Platform.

Continued use of the Platform after updates constitutes your acceptance of revised Terms.

4. Scope of Services

JewelsPe Solutions offers the following services:

1. Digital Investment:
   Subscribers can invest in gold, silver, or diamonds based on live market rates.
   The system dynamically updates commodity prices daily.

2. Jewellery Marketplace:
   Jewellers can list their shops, products, and offers. Subscribers may redeem their investment value to purchase jewellery from these verified sellers.

3. Wallet System:
   Each Subscriber and Jeweller has an in-app wallet to manage investment credits, purchases, and withdrawals.

4. Admin Oversight:
   JewelsPe monitors all transactions, ensures platform integrity, and collects a small commission from verified jewellers on successful sales.

5. User Registration & Account Responsibilities

1. Account Creation:
   Users must complete registration by providing valid personal or business details.
   Subscribers must share accurate contact, identification, and investment-related information.
   Jewellers must provide shop verification documents and bank details.
   
   

2. Confidentiality:
   You are responsible for maintaining the confidentiality of your login credentials. Any activity under your account will be considered authorized by you.
   
   

3. False Information:
   Providing false, misleading, or incomplete information may result in suspension or permanent termination of your account.
   
   

4. Multiple Accounts:
   Users are not allowed to maintain multiple accounts for the same role (Subscriber or Jeweller) without prior approval from JewelsPe.

6. Investment Terms

1. Investment Mode:
   Subscribers can invest any amount in supported commodities (gold, silver, etc.) based on real-time prices.
   
   

2. Pricing & Conversion:
   JewelsPe displays live market rates sourced from reputed suppliers or commodity feeds.
   The equivalent commodity quantity is calculated and displayed at the time of investment.
   
   

3. Returns / Growth:
   JewelsPe does not offer guaranteed returns or profits. The value of commodities may fluctuate based on market trends.
   
   

4. Redemption:
   Investments can be redeemed only by purchasing jewellery through listed jewellers or through wallet transactions, as applicable.
   
   

5. Refunds:
   Once a commodity investment or redemption transaction is confirmed, it cannot be reversed unless a technical error occurred.
   
   

6. Long-Term Plans:
   Subscribers may opt for recurring investment plans (6–12 months). Plan details, duration, and redemption rules are clearly displayed in the app.

7. Wallet Terms

1. Virtual Balance:
   The JewelsPe Wallet is a closed system wallet, not a bank account or digital payment instrument under RBI regulations.
   
   

2. Transactions:

• Amounts credited to the wallet can only be used for investments or jewellery purchases.

• Jewellers’ wallet balances represent receivables from completed sales.
  
  

3. Withdrawals (For Jewellers):

• Jewellers may request wallet withdrawals via NEFT or IMPS.

• The Admin processes withdrawals within 24 business hours.

• Transaction fees, if applicable, are deducted as per banking or processing charges.
  
  

4. Invalid Transactions:
   JewelsPe reserves the right to reverse transactions found to be fraudulent, erroneous, or violating these Terms.

8. Payment Gateway & Third-Party Services

1. JewelsPe uses verified third-party payment gateways for secure online payments.

2. All payment-related charges (transaction fees, taxes, merchant account charges) are borne by the user or jeweller as applicable.

3. Any delays, rejections, or technical failures caused by external payment systems are not the liability of JewelsPe Solutions.

4. JewelsPe may integrate WhatsApp Messaging API for notifications. Messaging costs, if any, are borne by the client or jeweller.

9. Jeweller Obligations

1. Jewellers must be legally registered businesses with valid trade licenses, GST, and KYC documents.

2. Product listings must be authentic, with genuine photographs, accurate prices, and transparent weight/purity details.

3. Jewellers are solely responsible for product quality, pricing, and timely delivery to customers.

4. JewelsPe reserves the right to delist or suspend any jeweller involved in fraudulent activity, misrepresentation, or non-compliance.

10. Platform Commission

JewelsPe charges a service commission on transactions made between Subscribers and Jewellers through the platform.
The applicable commission rate is defined in the jeweller’s onboarding agreement and may vary by product or region.
All commissions are automatically deducted at the time of transaction settlement.

11. Cancellation, Returns & Refunds

1. Investments:
   Investments once made are final and non-refundable, except in case of technical errors.

2. Jewellery Purchases:
   Return or exchange policies depend on the respective jeweller’s individual terms.
   JewelsPe is not liable for disputes regarding product quality, pricing, or delivery.

3. Wallet Withdrawals:
   Once processed, wallet withdrawals are considered final and irreversible.

4. Refund Timeline:
   Approved refunds (if applicable) are initiated within 5–7 business days of verification.

12. Data Privacy & Security

1. JewelsPe respects user privacy and complies with applicable data protection regulations.

2. All personal and financial data is securely encrypted.

3. JewelsPe does not share user data with unauthorized third parties, except when required by law or service providers.

4. Users are advised not to share OTPs, passwords, or wallet details with anyone.

13. Intellectual Property

1. All trademarks, brand names, logos, content, and designs on JewelsPe are the exclusive property of JewelsPe Solutions.

2. You may not copy, reproduce, distribute, or modify any part of the platform content without prior written consent.

3. Jewellers retain ownership of their respective product images and brand materials but grant JewelsPe a license to display them online.

14. Limitation of Liability

JewelsPe Solutions shall not be liable for:

• Any indirect, incidental, or consequential losses from the use of the Platform.

• Price fluctuations in commodities or jewellery.

• Delays or failures caused by network, banking, or third-party services.

• Product quality disputes between Subscribers and Jewellers.

Our total liability, under any claim, shall not exceed the total amount paid by the user to JewelsPe during the previous 30 days.

15. Indemnification

By using the Platform, you agree to indemnify and hold harmless JewelsPe Solutions, its employees, directors, and affiliates from any claims, damages, or legal actions arising from:

• Violation of these Terms.

• Misuse of the Platform or Wallet.

• Breach of law or third-party rights during your use.

16. Termination of Account

JewelsPe reserves the right to suspend or terminate your account immediately if:

• You engage in fraudulent or illegal activity.

• You misuse the platform or misrepresent information.

• You violate any clause of these Terms.

Upon termination, wallet balances will be reviewed and settled as per applicable conditions.

17. Compliance & Legal

1. All transactions must comply with Indian laws, including KYC (Know Your Customer) and AML (Anti-Money Laundering) norms.

2. JewelsPe reserves the right to request additional documents for verification.

3. Users are responsible for reporting and paying applicable taxes on their earnings or transactions.

18. Dispute Resolution

1. In case of any disputes, both parties agree to resolve matters amicably through written communication within 30 days.

2. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Kota, Rajasthan (India).

3. The governing law shall be Indian Law, and all proceedings shall be conducted in English.

19. Communication & Notifications

By using JewelsPe, you consent to receive:

• Transactional messages and alerts via SMS, Email, or WhatsApp.

• Updates about offers or system changes.

You may opt out of promotional communications anytime by contacting info@jewelspe.com.

20. Amendments

JewelsPe Solutions may revise these Terms periodically to comply with laws or improve services.
Updated Terms will be posted on our website and mobile app with the “Last Updated” date.
Users are advised to review them regularly. Continued use implies acceptance of all modifications.
